with breaking news. >> the old sheriff will be back in town. tonight the san francisco board of supervisors votes to reinstate suspended sheriff ross murkarimi. good evening, everyone. i'm jessica aguirre. >> and i'm janelle wang in forage mathai. the vote on murkarimi's future came down just in the last half hour. >> jean elle has the very latest. jean? >> reporter: this board meeting just ended, and for san francisco board of supervisor members voted not to uphold charges of official misconduct. and that means the mayor did not have enough votes to remove the sheriff from office, and he can now be reinstated. board members started deliberating at 9:30, many made emotional statements about family members being victims of domestic violence. but supervisors christina olagi, john avalos and jane kim said while what murkarimi did was wrong, the charter is too narrow to support removing him from office. >> while the emotion satisfaction and political expedience of removing an official for a crime that most of us find unacceptable is very tempting to me, that is precisely the danger of removing

mirkarimi the suspended san francisco sheriff. the board of supervisors is voting on whether to remove him from office for good. cbs 5 reporter elissa harrington is in san francisco with more on what is at stake. good morning. >>> reporter: good morning. this case has played out for months at city hall and this decision a big deal because it could set the precedent for misconduct cases in the future. sheriff ross mirkarimi pleaded guilty to a misdemeanor relating to a domestic violence dispute that left his wife with a bruised arm on new year's eve. nine months later we could find out if he stays or if he goes for official misconduct. his wife eliana lopez showed her neighbor a bruised arm which you can see in this video after her husband grabbed her during an argument. mirkarimi was sentenced to three years' probation, fined and ordered to undergo counseling. he was also placed on unpaid leave by mayor ed lee. since then, mirkarimi has been fighting for his job. his attorney says that the marital incident has nothing to do with his role has sheriff and he was also voted in. mayor lee want

come in time for halloween. >> following developing news out of san francisco right now. a woman is badly injured after a shooting and a car crash. >> reporter: it happened just before four this morning in city's western edition neighborhood. according to a detective a 30- year-old woman who was driving this car, you see flipped over -- that's now in the process of getting towed. she was shot four times and while on the way to the hospital she said she had been trying to park when she heard and felt the gun fire. police have been searching through the crime scene since early this morning marking shell casings and bullet holes. they say there were two shooters involve though they don't have any suspect descriptions. based on where all the shell casings are it seems to indicate that the shooters walked up to the car and opened fire. one of the detectives said they don't think it was a random attack. they suspect woman had a connection to the people who shot her. as far the woman's condition he is expected to survive. she was taken to the hospital and is having surgery and is in st
